Reservations Policies for all Gear Rentals

ALL RESERVATIONS MUST BE PAID IN ADVANCE

ALL PERSONS MAKING RESERVATIONS MUST REVIEW AND SIGN OUR POLICY AGREEMENTS & INFORMATION PRIOR TO RENTAL ONCE AT ONLINE CHECKOUT AND AGAIN IN PERSON AS HARD COPY. THERE ARE WAIVERS REQUIRED FROM GUARDIANS OF MINORS.

Cancellations must be made 72 hours in advance date/time of reservation to receive full refund.
There is no last minute refunds for illness, weather, early returns or non-usage.
Individuals named on the contract must be present at the time of pick up or item (s) will not be released.
Weather cancellations will be declared by YAK SHACK staff. In case of a weather cancellation, you will receive a credit to be applied to any future services.
There is no refunds for non-use.

Minimal Rental Requirements

You must be 18 years of age and have a current picture government issued identification.
It is best to reserve ahead of time.
Cancellations must be made 72 hours in advance for a 100% refund, 48 hours for 50% refund, a 5% booking fee is kept.
A 5% discount applied to 3 or more consecutive rental days.

LATE RETURN FEES

ITEMS NOT RETURNED BY SET RENTAL HOUR, THE CARD ON FILE WILL BE CHARGED FOR THE NEXT DAY USE. NON RETURNED ITEMS WILL BE CHARGED FULL PURCHASE PRICE OF ITEM RENTED TO CARD ON FILE.

Liability Release, Hold Harmless and Assumption of Risk Agreement

I acknowledge that I have the necessary skills to use the rented equipment (kayak, paddle board, or other) properly. I understand that the activity of kayaking, paddle boarding and other outdoor related water activities involve inherent hazards and other risks. The risks include but are not limited to: physical exertion, inclement weather, capsizing of watercraft, immersion in water, tides and currents, hypothermia, accidents or illness in remote areas, tripping or slipping on rocks, travel to/from site, other boats or boaters, equipment failure and malfunction, drowning and loss or damage to personal property are your responsibility.

Furthermore, unless on guided tour, YAK SHACK employees are not guides or instructors. They may suggest routes or areas or ways to maneuver and/or operate the equipment but are not responsible for any accident resulting in injury or death. Your navigation choices are ensuring that you safely enter or exit the kayak, or paddle board or any other equipment. I acknowledge that that the major credit card on file for such rented equipment (kayak, paddle board or other) will be charged for additional day if rented equipment is late for return after set rental hour/day, and non returned items will be charged at full purchase price of such rented item.

I. EXPRESS ASSUMPTION OF RISK

I nearby agree that he/she is operating or using the kayak (s), paddle boards or other equipment provided by YAK SHACK at his/her own risk. The undersigned agrees that he/she is voluntarily participating in all activities related to the operation, or use of the kayak and equipment, and assumes all risk of injury, damage or loss that might result.

II. WAIVER /RELEASE OF LIABILITY

By the execution of this Release & Agreement, the undersigned agrees that YAK SHACK shall not be liable for any damages arising from personal injuries sustained by the undersigned or any minor children under the undersigned custody, care and control as a result of any and all activities related to the operation, or use of Kayak (s), paddle boards or any other equipment provided by YAK SHACK. The undersigned assumes full responsibility for any such injuries or damages which may occur, and further agrees that YAK SHACK shall not be liable for any loss or theft of personal property.

III. LIABILITY TO THIRD PARTIES

The undersigned hereby agrees that he/she will indemnify and hold harmless YAK SHACK for all personal injuries, property damages, and or any other damages any and all third parties, including, but not limited to operator and passengers of other care, and control, as a result of any and all activities related to the operation or use of equipment provided by YAK SHACK.

IV. ACKNOWLEDGEMENT OF WAIVER AND RELEASE

The undersigned states that he/she has had sufficient time to review and Release & Hold Harmless Agreement and to ask any questions associated with this Release & Agreement. The undersigned further states that he/she has carefully read the foregoing Release and Hold Harmless Agreement, knows the contents thereof, and has signed said Release & Agreement as his/her own free act.

By renting our products online and checking the box that you agreed to these policies you do hereby agree to all terms of this Liability Release, Hold Harmless and Assumption of Risk Agreement.

V. MINOR PARENTAL CONSENT

If user is a Minor under 18 years of age: Parent or Guardian additional identification is required.

I certify that, as a Parent or Guardian with legal responsibility for the below listed Minors, I have read and consent to his/her release and agree to indemnify, release and hold harmless YAK SHACK and its staff of any all claims or liabilities which are brought by on or behalf of Minor, their heirs, siblings or parents, or are in any way incident to the child’s use or participation, to the fullest extent of the law.

You will be asked for the location of use, date of use, full names and ages of all minors using the equipment. We recommend preprinting the paperwork and collecting waivers from the guardians of other minors you intend to bring on your adventure.

VI. Damage Waiver

This Damage Waiver covers only damage to the rental equipment (kayak, paddle board or other), it does not cover transport on your vehicle.

Additional charges will be applied for any non returned, lost, or damage to equipment that is rendered unusable. Examples include cracks, dents large scratches, ripped padding on paddle boards, destroyed or sunken kayaks, or any such but not limited to other damages on other rented equipment. Please see attached pricing. If kayak or paddle board is damaged or lost in waterway and deemed salvageable you may be charged a salvage fee of up to $200 per hour.

Single Kayak = $500
Tandem Kayak = $1200
Paddle Board = $700
Paddle – Kayak = $75.00
Paddle – Paddle Board = $75.00
Life Vest = $75.00
Dry Bag = $60
Wet Suit = $200.00

This does not include all items to be replaced. Cost on items and not listed is per occurrence. I understand and acknowledge the damage waiver.
